JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-09-2017 Heard learned counsel for the petitioner and the State. The instant application is filed for quashing of the F.I.R. in Simari P.S. Case No. 118 of 2014 dated 02.07.2014. By efflux of time, the present application has become infructuous, as the court has reason to believe that after lodging of F.I.R. on 02.07.2014, the police must have completed the investigation, and either have submitted final form or charge-
Patna High Court Cr.Misc. No.43314 of 2014 (3) dt.01-09-2017 2/2 sheet. In any event, no useful purpose would be served, keeping the matter pending in this Court.
In case, the police has submitted charge-sheet against the petitioner and the court below has taken cognizance by passing any order adverse to the interest of the petitioner, liberty shall be available to the petitioner to challenge the same in accordance with law by filing appropriate petition before the court concerned. With the aforesaid liberty, the application stands disposed of.
