JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 The petitioners seek regular bail in connection with Thawe P.S. Case No. 95 of 2016, registered for offences punishable under Section 147, 148, 149, 323, 324, 302/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that only allegation against these petitioners are that they hold the hand and legs of the deceased, who was stabbed by other co-accused persons and there is no specific allegation of assault against these petitioners and they are lady and have been languishing in judicial custody since 30.07.2016.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that no specific allegation of assault has been levelled against these petitioners and they are lady and have been in judicial custody for about more than six months, let the petitioners above named, be
Patna High Court Cr.Misc. No.2825 of 2017 (2) dt.09-02-2017 2/2 released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Thawe P.S. Case No. 95 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners will cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
