JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 15-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Udwant Nagar P.S. Case No. 288 of 2021, instituted for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner was neither involved nor the motorcycle is in his name and he is nowhere connected with the said incident of seized liquor.

Taking into consideration the same, I am satisfied that no prima facie case is made out as against the petitioner under Section 30(a) of the Act.

Accordingly, I am inclined to allow the petitioner on

Patna High Court CR. MISC. No.48897 of 2021(2) dt.15-02-2022 2/2 bail, in the event of arrest he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
