The petitioner is in custody in connection with Mahua P.S. Case No.102 of 2019 for the offence under Section 395 of the Indian Penal Code.

Allegation against this petitioner is that the petitioner along with some unknown persons on the point of revolver locked the informant and his son inside the house and looted the cash of Rs.7 lacs and jewelry, mobile set, bank passbooks, check books, medical certificate, etc.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Learned counsel further submits that nothing was recovered from the exclusive possession of the petitioner. The alleged recovery is from the

Patna High Court CR. MISC. No.35372 of 2019(2) dt.30-05-2019 2/2 joint house of the joint family. Petitioner is in custody since 26.02.2019, yet he has not been put on TIP.

Considering the fact that petitioner has no criminal antecedent and he is in custody for more than three months, yet he has not been put on TIP, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur, in connection with Mahua P.S.
