JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-12-2017 In pursuant to the order dated 15.11.2017, a report has been sent by the learned Court of 1st Additional Sessions Judge, Aurangabad and it has been stated that the case is pending for framing of charges, however, in the meantime, a petition under Section 227 of the Cr. P. C. has been filed on behalf of the accused petitioner for his discharge and the same is pending adjudication for which next date for hearing is fixed for 14.12.2017. It appears that the petitioner is pursuing two parallel proceedings at the same time, which is not permissible under law. However, this case nobody had appeared on the last date of hearing i.e. on 15.11.2017. Today also nobody appears for the petitioner and it appears that the petitioner has lost interest in this case.

Patna High Court Cr.Misc. No.47495 of 2014 (4) dt.13-12-2017 2/2 Accordingly, the petition is dismissed on account of non-prosecution.
