====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-02-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under section 366A of the Indian Penal Code.

3. As per the prosecution case, informant's minor daughter aged about 14 years fled away from her house and informant suspected that the petitioner enticed away her daughter.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim in her 164 Cr.P.C. statement has denied the factum of kidnapping and has categorically stated that being vexed with scolding of her mother, she left the house

Patna High Court CR. MISC. No.49258 of 2024(5) dt.19-02-2025 2/2 out of her own sweet will. Her age has been stated as 19 years by the Court. Petitioner claims clean antecedent.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gaya in Magadh University Police Station Case No. 11 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
