JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/302/307/120B/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is not named in the F.I.R. F.I.R. named accused persons are alleged to have assaulted to the deceased causing death. During investigation it revealed that petitioner was also living in the vicinity and was also involved in the occurrence.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial

Patna High Court Cr.Misc. No.4117 of 2017 (3) dt.10-04-2017 2/2 Magistrate, East Champaran at Motihari/Successor Court, in connection with Pakridayal P.S. Case No.121 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
