Petitioner apprehends his arrest in connection with Keoti P.S. Case No.325/22, registered for the offence punishable u/s 304(B)/201/34 of the IPC.

As per the prosecution case, daughter of the informant has been killed by F.I.R. named accused persons including the petitioner (husband of the deceased) due to non-fulfillment of demand of dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to grudge. No such occurrence, in the manner as alleged, has ever taken place. The

Patna High Court CR. MISC. No.39823 of 2023(2) dt.11-07-2023 2/2 allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner is the husband of the deceased and has never made any dowry demand from the deceased. He has been living and working in Delhi as a labourer and on the alleged date, he was in Delhi. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, since petitioner is the husband of the deceased, I am not inclined to enlarge him on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
