2. The petitioner apprehends his arrest in a case registered for the offence under Sections 338/336(3) of the B.N.S., 2023 and Section 30(a) of Bihar Prohibition and Excise Act.
3. Total 27 liters of illicit foreign liquor has been recovered from a bamboo orchard and two motorcycles were seized on the spot.
4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of any of the seized motorcycles and has been made accused only on suspicion. Recovery has been made from an open place.
5. Learned A.P.P. for the State has opposed the prayer
Patna High Court CR. MISC. No.39471 of 2025(2) dt.26-06-2025 2/2 for anticipatory bail and submitted that petitioner has got one criminal antecedent of similar nature.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-II (Excise Act), Darbhanga in connection with Ghanshyampur P.S. Case No. 79 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S., 2023.
7. However, learned Court below is directed to verify as to whether petitioner is owner of any of the seized motorcycles and only after being satisfied, accept the bail-bonds of the petitioner.
