Petitioner is apprehending his arrest in connection with Muffasil P.S.Case no.218 of 2019 dated 28.3.2019 , registered for offences punishable under Sections 147, 148, 342, 323, 307 and 354 of the Indian Penal Code and Section 27 of the Arms ACt.
Prosecution story is that while the informant was harvesting the crops, the petitioner came with the Harvesting Machine and started harvesting the crops and when the informant protested he was assaulted by the 'BUT' portion of the Rifle causing injury to him and also injury to his mother and sister. There is allegation of misbehaving with his sister . Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.35295 of 2019(3) dt.08-08-2019 2/2 that there is land dispute between the parties and noting has been shown against any injury on the person of any of the informant or on other persons and the allegation is also of assault by the 'BUT' portion of the Rifle.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria Muffasil P.S.Case No.218 of 2019 dated 28.3.2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
