JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 29-06-2017 In the supplementary counter affidavit filed by the Bihar Public Service Commission on 9.5.2017, in paras 4,5 and 6 averments have been made with regard to the action taken by the Commission for appointment to the post of Assistant Prosecution Officer.

It is seen that the advertisements were made in the matter and as indicated in para-4, Advertisement Nos. 39/2009, 41/2011, 42/2011 and 01/2013 were published. Final results of Advertisement No. 39/2009 were published by the Commission on 16.11.2016 and recommendation has been sent to the Government

Patna High Court CWJC No.15383 of 2016 (5) dt.29-06-2017 2/2 on 6.12.2016. Final results of Advertisement No. 41/2011 has been published by the Commission on 8.2.2017 and recommendation for appointment of the successful candidates has been sent to the Department. Likewise, with regard to advertisement No. 42 of 2011 advertisement has been issued and the interview was held between 5th June, 2017 to 8th June, 2017. and final result was published on 14.6.2017 and further selection process is continuing with regard to Advertisement No. 1/2013 and written examination has been held and the result would be published and process is expedited.

Keeping in view the aforesaid assertion made by the Bihar Public Service Commission, we are satisfied that for filling up the post of Assistant Prosecution Officers, the Bihar Public Service Commission will conclude the process preferably within a period of three months from the date of receipt/production of a certified copy of this order and thereafter, the State Government shall expedite the appointment on recommended post within a reasonable period.

With the aforesaid, we see no reason to grant any indulgence in the matter.

The petition is disposed of.
