The petitioner apprehends his arrest in Akbarpur P.S. Case No.362 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The petitioner is named in the FIR on the allegation that the petitioner was selling liquor and he had kept liquor in his barren land.

Learned counsel for the petitioner submits that four litres of liquor was recovered from the barren land of the petitioner. The recovery is made from open field. The petitioner has got no criminal antecedent. The recovery does not appear to have been made from possession of the petitioner. Taking into consideration the facts aforesaid,

Patna High Court CR. MISC. No.35830 of 2020(2) dt.23-03-2021 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Akbarpur P.S. Case No.362 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
