The petitioner seeks bail in connection with Sour Bazar P.S. Case No. 785 of 2023 instituted for the offence under Sections 399, 402, 147, 148, 149, 342, 323, 324, 325, 307, 332, 333, 337, 338, 336, 353, 224 and 225 of the Indian Penal Code. 3.

Prosecution case in a nutshell is that while patrolling, police party were attacked by the accused persons including the petitioner by various means, due to which they sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11-12-2023. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation of assault against the petitioner. There is general and omnibus allegation attributed to the petitioner. It is next submitted that charge sheet has been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sour Bazar P.S. Case No. 785 of 2023.
