23-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Mansoorchak P.S. Case No. 32 of 2019 (S.T. Case No. 326 of 2021), registered for the offence under Section 304(B) of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

As per the prosecution case, thrust of the accusation is against son of the petitioner, who killed his wife by setting her on fire, due to non-fulfillment of demand of dowry. Petitioner is father-in-law of deceased.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. Neither there is any allegation against this petitioner of demand of dowry nor any overt act has been alleged against him in the case diary. Husband of the deceased has already been acquitted by the learned trial court on 01.07.2021. Petitioner is in custody since 13.03.2021.

Patna High Court CR. MISC. No.48864 of 2021(2) dt.23-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Begusarai in connection with S.T. Case No. 326 of 2021, arising out of Mansoorchak P.S. Case No. 32 of 2019.
