Having regard to the fact that the amount of pension, gratuity and commuted value of pension has already been sanctioned and authorized by the Accountant General way back on 04.09.2014, as per the order contained in Annexure-1 and 2 series, this Court would direct the Treasury Officer, Gaya to ensure that if these orders are still valid and the petitioner has not been paid the amount of arrears of current pension, gratuity and commuted value of pension, that must be

Patna High Court CWJC No.5724 of 2015 (2) dt.26-06-2015 paid to him within a maximum period of three months from today.

It is made clear that neither the payment of salary as claimed in this writ application is not a retirement benefit nor any direction can be issued to the respondents as with regard to payment of salary by this Court in this writ petition confined to payment of retirement benefit. The petitioner however shall be at liberty to claim such admissible amount amount of salary in a separate proceeding before the competent authority/court.

With the aforementioned observation and direction, this application is disposed of.
