2. The petitioner apprehend his arrest in connection with C.R. No. 1464 of 2021 T.R. No. 1663 of 2022 registered for the offences punishable under Sections 420 of the Indian Penal Code.

3. It is alleged that the petitioner took a loan of Rs. 8,90,000/- from the complainant but he did not return the loan amount to the complainant and misbehaved with the complainant.

4. It is submitted on behalf of the petitioner that the petitioner denies the allegation and submits that he has never

Patna High Court CR. MISC. No.40804 of 2023(2) dt.01-08-2023 2/2 taken any loan from the complainant. There is no chit of paper on record to show any financial transaction between the petitioner and complainant. In absence of such document, no case is made out against this petitioner.

5. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate Ist Class, Samastipur in connection with C.R. No. 1464 of 2021 T.R. No. 1663 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
