The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submitted that there is no recovery from the conscious possession of the petitioner and for para 3 of the bail petition appeared that petitioner is involved in the same nature of Excise Case No. 142 of 2018. In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Excise Case No. 166 of 2019 from the Court of learned 7th Additional

Patna High Court CR. MISC. No.36762 of 2019(4) dt.14-08-2019 2/2 Sessions Judge cum Special Judge, Excise, Motihari, East Champaran.

Accordingly, the application is dismissed.
