JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2017 The petitioner is in custody since 03.06.2016 in connection with Dumraon (Naya Tola) P.S. Case No. 162 of 2016 registered for offences punishable under Sections 414 of the Indian Penal Code and Section 25(1-B)a/26/35 of the Arms Act. It has been submitted on behalf of the petitioner that he has been falsely implicated in this case. As a matter of fact he has been arrested in one case and has been remanded in all other cases only on the basis of suspicion. It has further been submitted that other co-accused of the case has already been granted; the privilege of bail by lower court itself and the petitioner has been in custody for more than eight months.

Having heard both sides, considering the facts and circumstances of the case and also that the petitioner has criminal

Patna High Court Cr.Misc. No.2793 of 2017 (2) dt.08-02-2017 2/2 antecedent as he is accused in as many as three other cases, I am not inclined to grant the petitioner, the privilege of regular bail at this stage.

However, petitioner may renew his prayer for bail, once charges are framed in this case.
