Mr. Chandra Sen Prasad Singh, learned counsel appearing for the Railways in reference to the counter affidavit with a particular reference to allotment order at Annexure R/1 has submitted that the grievance of the petitioner has been redressed inasmuch as vide order dated 17.3.2017 Quarter No.1666-D/Type-III, Mansnagar Colony, Mughalsarai has been allotted to the petitioner Rajesh Kumar by the competent authority by cancelling the previous allotment to Shiv Kumar Singh.

Although a rejoinder to the counter affidavit has been filed but it is stated by Mr. Singh, learned counsel appearing for the Railways that the issues raised therein is distinct from the relief claimed herein for now the petitioner wants a different
