The petitioner is apprehending his arrest in connection with Complaint Case No.C-137 of 2018 registered for offences punishable under Sections 498(A), 379, 323, 307, 504 and 506 of the Indian Penal Code and Section 3⁄4 (A) of the D.P.Act. As per the complaint petition, there is allegation of demand of Rs.05 lac from the complainant and assaulting her and ousting her from the house.
Submission of the learned counsel for the petitioner is that he is still ready to keep her with dignity and care. On the other hand the leanred counsel for the O.P.no.2 has submitted

It is also submitted that earlier vide order dated 27.6.2019 the petitioner was directed to pay Rs.5,000/- per month to the O.P.no.2 but up till now payment of only one month has been made to the complainant and rest of the amount has not been paid and that also shows conduct of the petitioner.

Having heard both sides and considering the the stands of the parties, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of three weeks from the date of receipt of the order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar, Motihari, East Champaran in connection with Complaint Case No.C-1373 of 2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will continue to pay Rs.5,000/- per month to the O.P.no.2 till any order is passed by the learned Family Court and with further condition that he has to clear the dues amount within two months..
