Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State in virtual Court proceeding.
Petitioner seeks bail in a case registered in connection with Pipariya P. S Case No. 53 of 2021 for the offences punishable under Section 302, 201/34 of the Indian Penal Code .
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. In fact petitioner is cousin brother of husband of the deceased. The petitioner has no concerned with the alleged occurrence. The petitioner is an outsider and nothing is specific against the
Patna High Court CR. MISC. No.48447 of 2021(5) dt.20-01-2022 2/2 petitioner to substitute that he was involved in the said crime. Petitioner is in custody since 06.06.2021.
Learned counsel for the State vehemently opposes the prayer for bail of the petitioner on the basis of material available on the record as well as case diary. He further submits that there is sufficient material in the case diary( Para 71 and
55) which shows the involvement of the petitioner in the present crime and the petitioner is also involved in the illegal works with the husband of the deceased Accordingly, I am not inclined to enlarge the petitioner on bail in connection with Pipariya P.S.Case No. 53 of 2021, pending in the court of learned Chief Judicial Magistrate, Lakhisarai/ successor court.
