The petitioner seeks bail in connection with Bhagwanganj P.S. Case No.11 of 2015 registered under Sections 428, 302 and 120B/34 of the Indian Penal Code. The accusation of the informant is that the marriage of his sister Dolly Devi was performed with this petitioner before 7-8 years. After two years of marriage, his sister was being tortured by this petitioner in drunken stage. The cause of torturing to his sister was that this petitioner had illicit relation with his sister-in-law. On 22.02.2015, in the morning, Dolly Devi, the sister of the informant, informed the informant about administering sulphas to her by this petitioner and his other in-laws. Patna High Court Cr.Misc. No.4836 of 2017 (3) dt.30-03-2017 2/2 house of his sister Dolly Devi and found her in serious condition. Dolly Devi, the sister of the informant, was rushed to the clinic of Dr. Awadhesh Kumar at Masaurhi for treatment but she died there in course of treatment.

Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the husband of the deceased Dolly Devi, the sister of the informant. In fact, the deceased Dolly Devi, the sister of the informant, became seriously ill and she was rushed to the clinic of Dr. Awadhesh Kumar at Masaurhi, by this petitioner where on the information, the informant, who is the brother of the deceased Dolly Devi, came there and in his presence, she died but with an ulterior motive, the petitioner and his other family members have falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 13.02.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Masaurhi, Patna, in connection with Bhagwanganj P.S. Case No.11 of 2015.
