The petitioner seeks bail in Vaishali P. S. Case No. 164 of 2018 instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.
The written report has been filed by Choukidar stating that he found the dead body of a lady near Gas godown. The FIR has been registered against unknown on the basis of the aforesaid statement of Choukidar.
During course of investigation, the aforesaid dead body of lady was identified by the mother of deceased on the basis of photograph. Thereafter, mother of the deceased sent application to SHO, Vaishali, stating that her daughter Sonali Chatterjee was married to this petitioner on 27.9.2009, who is presently
Patna High Court CR. MISC. No.34337 of 2019(4) dt.07-08-2019 2/2 working in Barauni Refinery since 2015. He used to torture her daughter for demand of dowry. She has further made allegation that for the last fifteen days, no communication could be made between her and her daughter, she visited her daughter's house, and came to know that the petitioner along with other family members have murdered her daughter and disposed of her dead body. But, no such information was earlier given by the mother of the deceased prior to recovery of the dead body of her daughter.
In this manner, mere suspicion has been raised against this petitioner.
Petitioner is in custody since 28.1.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Vaishali at Hajipur in connection with Vaishali P. S. Case No.164 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
