JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 75 of 2014, arising out of Karpi P.S. Case No. 122 of 2014, registered for the offences punishable under Sections 420, 406, 409/34 of the Indian Penal Code.

It appears from perusal of the record that earlier petitioner has moved this Court for grant of anticipatory bail and this Court vide order dated 9.4.2015 in Cr.Misc.No. 36323 of 2014 has rejected the prayer and petitioner was advised to surrender and pray for regular bail. However, it appears that after four years again he has come for grant of anticipatory bail on the ground that he is ready to deposit the money as per agreement and also on the ground of merit.

Heard learned counsel for the petitioner and learned

In the above facts and circumstances, I am not inclined to interfere with the earlier order passed by this Court. The petitioner, if so desires, may surrender and deposit the amount in the court below and learned court below shall consider the same and pass an appropriate order. With the above observation, this application is dismissed.
