JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-08-2017 Heard learned Counsel for the parties concerned. This application has been filed for restoring CWJC No. 12781 of 1993, which stood dismissed for default, by order, dated 21.07.2015. By the said order, dated 21.07.2015, two applications, namely, CWJC No. 9187 of 2000 (Sidh Nath Singh v. State of Bihar and Others) and CWJC No. 12781 of 1993 (Dharichhana Devi v. The State of Bihar and Another) came to be disposed of. An order, dated 21.07.2000, passed in Revenue Misc. No. 58/89-90, by the Collector, Bhojpur, in purported exercise of power under Section 32 of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, was under challenge.

Patna High Court MJC No.3161 of 2016(4) dt.23-08-2017 2/2 The petitioner is the sole legal representative of Dharichhni Devi, who was impleaded as respondent no. 3 in CWJC No. 9187 of 2000. The said CWJC No. 9187 of 2000 has been allowed by this Court by the said order, dated 21.07.2015, whereby the matter has been remanded back to the Collector, Bhojpur, to pass an order afresh in accordance with law. In that background, no purpose will be served by restoring CWJC No. 12781 of 1993, in that background.

This application stands disposed of.
