====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 07-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Muzaffarpur Mahila P.S. Case No.98 of 2016 registered under Sections 147, 149, 323, 354, 354(B), 498(A), 120(B), 504, 379 and 509 of the Indian Penal Code.

The accusation is that the informant had gone to attend the Panchayati, which was arranged by her husband, where she was misbehaved by her husband and 27 others and they also outraged her modesty in spite of protest made by her son. Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. but the

Patna High Court Cr.Misc. No.2468 of 2017 (2) dt.07-02-2017 2/2 specific overt act has been attributed to the co-accused Kedar Sahni and Vijay Sahni. The petitioner having no criminal antecedent is in custody since 09.08.2016. Moreover, the similarly situated co-accused Raj Karan Sahni vide order dated 19.01.2017 passed in Criminal Misc. No.46433 of 2016 has already been granted bail by a Bench of this Court. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub Judge-VII, Muzaffarpur, in connection with Muzaffarpur Mahila P.S. Case No.98 of 2016.
