ANJANA MISHRA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Complaint Case No. 1664/2012 for the offences under Sections 147, 341, 323 and 354 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the complainant has lodged the present case only on account of land dispute between the parties and a partition suit bearing Partition Suit No. 132/2000 is also pending before the learned Munsif, Muzaffarpur. Learned counsel for the petitioners further submits that prior to the present case another case being Kazra P.S.Case No. 166/2012 was also filed against the husband of the

Patna High Court Cr.Misc. No.40082 of 2014 (2) dt.25-03-2015 2/2 informant by petitioner no.4 regarding land dispute. Considering the nature of allegation, let the petitioners, named above, in the event of their arrest or surrender in the court below within two weeks from the date of receipt/ production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Miss. Kalpana Srivastava, Judicial Magistrate, 1st Class, Muzaffarpur in connection with Complaint Case No. 1664/12 (Tr. No. 3818/2014), subject to the conditions as laid down u/s 438(2) Cr.P.C.
