2. The petitioner apprehends his arrest in a case registered for the offence under Section 365 of the Indian Penal Code.
3. Informant suspects that this petitioner has committed the murder of his son.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, informant is not eye-witness to the alleged occurrence and only on suspicion, petitioner has been made accused. There is delay of seven days in lodging the F.I.R. During course of investigation, no tangible material has come to suggest the complicity of the petitioner in the aforesaid crime. During investigation, it has also come that there was strained
Patna High Court CR. MISC. No.42962 of 2024(4) dt.19-09-2024 2/2 relation between informant and deceased, since informant has solemnized second marriage after death of his first wife (mother of deceased). Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Phulwari Sharif P.S. Case No. 34 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
