JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 467, 468, 469, 471, 420 and 409/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is Headmaster of Bahuara Primary School under the district of Buxar and for the same transaction another case i.e. Rajpur P.S. Case No. 118 of 2009 was instituted. He submits that in that case petitioner and one Ravikant Singh were made accused. In order to pre-empt his accusation in the earlier case, the said Ravikant Singh has got instituted the present case implicating the petitioner. It has further been contended

Patna High Court Cr.Misc. No.19739 of 2015 (3) dt.09-07-2015 2/2 that the petitioner has been granted anticipatory bail in the said Rajpur P.S. Case No. 118 of 2009.

I find substance in the submission made on behalf of the petitioner. The present First Information Report has been instituted for the transactions which are said to have taken place in the year 2009. The First Information Report came to be instituted in 2013.

In view of the submission as above, let the petitioner above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 197 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J.) Vats/- U T
