Petitioners are in custody since 30.10.2016 in connection with Nathnagar P.S. Case No. 305 of 2016 registered under Sections 25(1-AA), 25(1-b)A, 26 and 35 of the Arms Act. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. In fact, nothing has been recovered from the conscious possession of the petitioners. Moreover, the co-accused, Rajesh Yadav, having more or less similar allegation, has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 1111 of 2017. Charges have already been framed in this case. The petitioners are rotting in custody for the last four months.

Patna High Court Cr.Misc. No.3366 of 2017 (3) dt.27-03-2017 Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Bhagalpur in connection with Nathnagar P.S. Case No. 305 of 2016 corresponding to G.R. No. 3726 of 2016.
