JUSTICE MIHIR KUMAR JHA ORAL ORDER 27-03-2015 Having regard to the pleadings on record, though this Court is satisfied that the petitioner was deprived of a reasonable opportunity to appear in the medical test either due to admit card being sent by the ordinary post to have been not served on the petitioner or due to his being not able to download his admit card in absence of any information, this Court would find it now difficult to give any relief to the petitioner because not only the selection process of the year 2008 has already been completed, the process of next advertisement of the year 2009 also has been taken up wherein the petitioner having participated had not been declared successful.
Nonetheless, this Court, having found that the
Patna High Court CWJC No.7614 of 2014 (4) dt.27-03-2015 petitioner is an ex-army personnel and was deprived of reasonable opportunity in the selection process of the year 2008, would direct the authorities to give the petitioner one more chance of being considered along with the others in the next advertisement and, for that purpose, if the petitioner has already exceeded the maximum age prescribed in the advertisement, his age may be relaxed only for one selection in the next advertisement.
With the aforementioned observation and direction, this application is disposed of.
