The petitioner seeks bail in connection with Agiaon (G) P.S. Case No. 09 of 2020 dated 17.01.2020 instituted for the offences under Sections 394 of the Indian Penal Code. The petitioner has not been named in the F.I.R.. Since the petitioner was remanded in another case viz Agiaon P.S. Case No. 12 of 2020 and is alleged to have made a confession therein. Based on that confession, he has been remanded in the present case also. Under similar circumstances, it has been urged on behalf of the petitioner that he had earlier been made accused in four other cases, in all of which, he has been granted bail.

Mr. Ravindra Kumar, learned counsel for the petitioner is not in a position to inform this Court about the stage of the case but only submits that for the last two years, because of Covid-19 pandemic, no case has been taken to its logical conclusion.

Considering the aforenoted submissions and taking into account the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Bhojpur, Ara in connection with Agiaon (G) P.S. Case No. 09 of 2020.

However, it is cautioned that if the petitioner does not show up in trial proceedings for two consecutive occasions without prior permission of the trial court, his bail granted to him by this Court shall be liable to be cancelled. (Ashutosh Kumar, J) rishi/- U T
