JUSTICE PARTHA SARTHY ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Naubatpur P.S. Case no. 433 of 2019 registered under sections 386, 387, 504, 506 and 120B of the Indian Penal Code and section 27 of the Arms Act. As per allegation in the F.I.R., it is stated by the informant that the accused persons came and made a demand of Rs.1 lac stating that a lot of money had been spent in fighting the criminal case of the leader of their gang, the petitioner herein.

It is submitted by learned counsel for the petitioner that the allegation as levelled in the F.I.R. are false and

Admittedly, no direct allegations have been leveled against the petitioner who is in custody since 19.9.2019 and has been implicated in the case because of his antecedents. The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner is accused in as many as 15 cases from before and it is for him that the other accused persons were making demand of rangdari. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, allegation against the petitioner in the F.I.R. together with grant of bail to other accused vide orders contained in Annexures - 3 and 4, this Court is inclined to enlarge the petitioner on bail.

The petitioner is directed to be enlarged on bail in connection with Naubatpur P.S. Case no. 433 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur.
