The petitioner apprehends his arrest in Kharagpur P.S. Case No. 197 of 2014, registered for the offences punishable under Sections 379 and 461 of the Indian Penal Code. The petitioner is not named in the First Information Report. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of co-accused but it is submitted that the petitioner has got no criminal antecedent.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the above named petitioner is rejected in connection with Kharagpur P.S. Case No. 197 of 2014, pending in

Patna High Court Cr.Misc. No.16583 of 2015 (2) dt.01-05-2015 the court of the learned S.D.J.M., Munger.

The petitioner is directed to surrender in the court below and the court below shall consider the prayer for regular bail of the petitioner considering the fact that only there is confessional statement of co-accused and dispose of the bail petition of the petitioner on the same day.
