The petitioner seeks bail in connection with Ara Nawada P.S. Case No.515 of 2016 registered under Sections 272 and 273/34 of the Indian Penal Code besides Sections 27 and 54 of the Bihar Excise Amendment Act, 2016.

The accusation is of recovery of 127 bottles, each containing 750 ml. Indian Made Foreign Liquor, from a tempo in which the petitioner was found sitting.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is a labourer and he had no knowledge about carrying of the aforesaid Indian Made Foreign Liquor on the

Patna High Court Cr.Misc. No.2103 of 2017 (2) dt.23-01-2017 2/2 tempo in which he was found sitting. Further submission is that the petitioner having no criminal antecedent is in custody since 22.08.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Nawada P.S. Case No.515 of 2016.
