Petitioner seeks bail in connection with Parihar P.S. Case No. 72 of 2016 registered under Sections- 376, 506, 34 of the Indian Penal Code and sections 4/8 of the POCSO Act.

Learned counsel for the petitioner submits that allegations levelled against this petitioner are false. Clothes of the victim were sent for examination to the Forensic Science Laboratory and the FSL report does not indicate any sign of rape. Medical report enclosed in the case diary also shows that there is no sign of rape. Final form has been submitted in the case. Petitioner has no criminal antecedent and is in custody

Patna High Court Cr.Misc. No.4200 of 2017 (4) dt.17-04-2017 2/2 since 29.11.2016.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Parihar P.S. Case No. 72 of 2016.
