The petitioners seek bail in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 117 of 2020, dated 20.03.2020, instituted for the offences under Sections 414 of the Indian Penal Code and Sections 30(a) and 30(b) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It appears that several persons were apprehended
Patna High Court CR. MISC. No.35904 of 2020(2) dt.22-01-2021 2/2 by the police during the raid in a village and the petitioners were also arrested in the same transaction. From their possession, 5 litres of liquor each was recovered. The petitioners are stated to be in custody since 20.03.2020. Petitioner No. 1 was made accused earlier in a case in which he is on bail, whereas petitioner No. 2 has clean antecedents.
Considering the nature of accusation against the petitioners and their period of custody, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 117 of 2020.
