JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by the learned counsel for the informant opposite party no.2. The petitioner is apprehending his arrest in Khagaul P.S. Case No.118/16 (G.R.No.2265/16) for the offence under Sections 498A, 504, 313/34 of the I.P.C.
The accusation is of torturing and causing assault to the informant/ O.P.No.2 by her husband (petitioner) and other inlaws for non-fulfillment of the dowry demand and aborting the pregnancy of the informant and also ousting the informant/opposite party no.2 from her matrimonial house
Patna High Court Cr.Misc. No.4510 of 2017 (6) dt.16-05-2017 2/3 snatching her all belongings.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the informant/O.P.No.2. On 21.03.2017after hearing the learned counsel for the petitioner and the learned counsel for the informant order was passed for calling for case diary with direction to not take coercive step against the petitioner. Thereafter case was listed on 18.4.2017 and on the prayer made on behalf of petitioner order was passed to list the case after two weeks. Thereafter the petitioner approached the informant to take her to her matrimonial house but she refused.
The learned counsel for the informant submits that while the petitioner had gone to the parental village of the informant but he did not approach the informant for her bidai as such he is not ready to go with the petitioner. Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Raghwandra Narayan Singh, J.M. 1st Class, Danapur, in Khagaul P.S.Case No.118 of 2016 subject to the conditions as laid down
