The petitioner seeks bail in Sessions Trial No. 216 of 2014, arising out of Kadwa P.S. Case No. 41 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 08.04.2015 with a direction to the trial court to conclude the trial within nine months from the date of receipt/production of a copy of this order. Learned counsel for the petitioner submits that the trial has not yet been concluded. A report was called for and the Additional Sessions Judge, I, Katihar reported that the prosecution has already examined eight witnesses and the case is fixed for examination of
Patna High Court Cr.Misc. No.1924 of 2017 (3) dt.01-03-2017 2/2 the defence witnesses.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
