This is an application for bail in connection with Nayagaon P.S.Case No. 69 of 2015 registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner and other co-accused persons have already been granted bail. It has further been submitted that the parties have compromised the dispute between the parties.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and considering the fact
Patna High Court Cr.Misc. No.2913 of 2017 (2) dt.13-02-2017 2/2 petitioner is husband and there is allegation against him, I am not inclined to grant bail to the petitioner.
However, petitioner may renew his prayer for bail before the court below after framing of charge in this case and the court below will consider the materials on the record and the fact that other co-accused persons have been granted bail and pass appropriate order, preferably on the same day. With the above observations, this application is disposed of.
