1. Heard learned counsel for the petitioners and the learned APP for the State.

2. The petitioners apprehend their arrest in connection with Roh P.S. Case No. 91 of 2024 dated 19.03.2024 registered for the offence(s) punishable under Section(s) 341, 323, 307, 354, 379, 427, 504, 506/ 34 of the Indian Penal Code.

Mr. Deepak Kumar, learned counsel for the petitioners submits that there is case and counter case in between both the parties, three persons are said to have sustained injuries in the alleged occurrence, whose injury reports have been filed as Annexure-P/2 series and the same show that they sustained very superficial injuries and the FIR

Patna High Court CR. MISC. No.41566 of 2024(2) dt.09-07-2024 2/2 itself shows that the alleged occurrence was not pre-planned and the petitioners have fair and clean antecedents.

4. Mr. Nawal Kishore Prasad, learned APP appearing for the State has opposed the bail prayer of the petitioners.

Considering the above submissions and mainly the genesis of the occurrence and coupled with the nature of the injuries sustained by the so-called injured persons and also fair and clean antecedents of the petitioners, this court is inclined to grant the relief of anticipate bail. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Roh P.S. Case No. 91 of 2024 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
