The petitioner apprehends his arrest in Sahiyara P.S. Case No. 28 of 2019, registered for the offences punishable under Sections 188, 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. On secret information raid was conducted by the police, near the house of the petitioner and, one co-accused Kanti lal Paswan was apprehended on the spot, who disclosed the name of petitioner as one of his accomplices. On search, 18 litres of country made liquour was recovered from the bag of co-accused person.

It is submitted on behalf of petitioner that nothing has been recovered from possession of this petitioner. There is

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-cum-Special Judge Excise Act, Sitamarhi in connection with Sahiyara P.S. Case No. 28 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
