2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 325, 307, 354, 447, 448, 379, 380, 504, 506 of the Indian Penal Code and section 27 of the Arms Act.
3. Allegation against these petitioners is of commission of assault with iron rod and lathi on the head of informant.
4. It is submitted that there is case and counter case. Due to land dispute between the parties, petitioners have been falsely implicated in this case. The doctor has found the injury
Patna High Court CR. MISC. No.42547 of 2023(2) dt.04-08-2023 2/2 sustained by the injured simple in nature. Petitioners claim clean antecedents.
5. Counsel for informant however vehemently opposed the prayer for bail.
6. Considering the facts aforesaid, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Samastipur in connection with Tajpur P.S. Case No. 463 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
