2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 01.05.2024 in Cr. Misc. No. 27502 of 2024.

3. The petitioner seeks bail in connection with Nawada Town P.S. Case No. 252 of 2024 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

4. As per the prosecution case, 137.875 litres of illicit liquor has been recovered from the house of the petitioner.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 07.05.2024 having clean antecedent. He further submits that

Patna High Court CR. MISC. No.44781 of 2024(2) dt.19-07-2024 2/2 the petitioner is ready to donate Rs. 20,000/- (Rupees Twenty Thousand Only) in some charitable organization without accepting his guilt.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-1, Nawada in connection with Nawada Town P.S. Cae No. 252 of 2024.

8. This is also subject to the condition that the petitioner shall deposit an amount of Rs. 20,000/- (Rupees Twenty Thousand Only) in Ramakrishna Mission Ashrama, Nala Road, Patna and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
