2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 307, 354, 337, 338, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, this petitioner is alleged to have assaulted husband of informant by means of sword.

4. It is submitted by learned counsel appearing on behalf of the petitioner that though there is allegation of assault against this petitioner but doctor has found the injuries sustained by the injured to be simple in nature. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State and learned counsel

Patna High Court CR. MISC. No.42157 of 2024(2) dt.13-09-2024 2/2 appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, nature of injuries sustained by the injured and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 525 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
