The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 409/34 of the Indian Penal Code.

It is alleged that the petitioners received monetary benefits under the Indira Awash Scheme through their bank account without their names being included in the beneficiary list.

It is submitted by the learned counsel for the petitioners that no sooner the petitioners came to know about

Patna High Court Cr.Misc. No.43732 of 2014 (2) dt.06-02-2015 the fact that their names were not in the beneficiary list, they returned the alleged amount. Statement in this regard has been made in para-10 of the petition. It is further submitted that other First Information Report named accused persons have been granted bail though the case was instituted in the year 2010. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the above fact and that the petitioners are ladies, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhau P.S. Case No. 120 of 2010, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
