The petitioner, who is in custody since 10.06.2020 seeks bail in connection with Chhatauni P.S. Case No. 176 of 2020 (G.R. No. 3876/2020) instituted for the offence under Section 379 of the Indian Penal Code.

A motorcycle which had been parked by the informant was stolen away.

The petitioner has not been named in the First Information Report and his prosecution in the instant case is only on the basis of confession of an arrested accused

Patna High Court CR. MISC. No.36495 of 2020(2) dt.30-01-2021 2/2 person. There is no recovery of any incriminating material from the petitioner.

Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chhatauni P.S. Case No. 176 of 2020 (G.R. No. 3876/2020).
