The petitioner apprehends his arrest in Bettiah Muffasil (Manuapul) P.S. Case No. 93/2012, registered for the offences punishable under Sections 304(B) and other Sections of the Indian Penal Code.

The father of the deceased made allegation against the petitioner that due to non-fulfillment of demand of dowry the petitioner and other family members killed his daughter. It is submitted that the petitioner is of course the husband of the deceased but during course of investigation it has come in the supervision note as well as the statement of the witnesses that the victim suddenly fell down and while she was

Patna High Court Cr.Misc. No.16719 of 2015 (3) dt.01-07-2015 being taken to the hospital, she died.

Considering the facts aforesaid and the fact that the petitioner is the husband and his wife died within five years of her marriage, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Rakhi/- U T
