JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-01-2022 At the outset, learned counsel for the petitioner prays for correction of case number mentioned in the prayer portion of the bail petition. He submits that he has also filed supplementary affidavit in this regard.

Let the mentioning of case no. in the prayer portion of the bail petition be read as 'Special Case No. 2/2019' in place of Special Case no. 9/2019'.

Heard both parties.

The petitioner seeks bail in connection with Special Case No. 2 of 2019 arising out of RC Case No. 9/A/18 was registered against unknown for offences under Sections 120(B) r/w 409, 420, 467, 468, 471 of the Indian Penal Code and section 13(2) r/w 13(1)(c) and 13(1)(d) of the Prevention of Corruption Act.

It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case alleging that the petitioner, as a part of criminal conspiracy, had filled up a false pay in slip/deposit slip/bill for crediting cheques which were passed by the Senior manager.

No.50551 of 2021(2) dt.24-01-2022 2/2 Petitioner at the relevant time was the clerk in Bank of Baroda, Main branch, Ghanta Ghar, Bhagalpur and no specific allegation has been made against this petitioner. Trial is not likely to be taken up in near future. Petitioner is in custody since 3.10.2019. Chargesheet has already been submitted. Other similarly situated co-accused have been granted bail by this Court vide paragraph 5 of the bail petition.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge CBI -II, Patna in connection with Special Case No. 2 of 2019 arising out of RC Case No. 9/A/18.
