JUSTICE SANJAY PRIYA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.
There is allegation against the petitioner that he assaulted husband of the informant on head with Farsa. The injury report has been annexed as Annexure-2 wherein the doctor has found lacerated wound on skull (forehead) of size 2" x 1/2" and Pain & Swelling in left wrist and hand. The opinion was reserved till X-ray report received but X-ray report is not available.
From the order of learned Sessions Judge, it appears that there is no repetition of blow. The petitioner is in custody

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram at Rohtas, in connection with Sheosagar P.S. Case No. 172 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
